Terms & Conditions
1. Scope and seller
These terms apply to all orders placed through this website with [full legal name], [street, postcode] Delmenhorst, Germany (“we”, “the studio”). Consumer protection provisions of German and EU law remain unaffected.
2. Products
Unless stated otherwise, every painting offered here is a unique original — one of one, signed by the artist and accompanied by a hand-numbered Certificate of Authenticity. Screen colours can differ slightly from the physical work; minor deviations are part of the nature of hand-made art and are no defect. Hand-painted postcards and minis are individually made; small variations between pieces are intended.
3. Ordering and conclusion of contract
- Add works to the cart, enter the delivery details and choose a shipping method.
- By clicking the order button (“Order with obligation to pay”) you make a binding offer and are redirected to our payment provider Stripe to complete payment.
- The purchase contract is concluded when we accept your order by sending the order confirmation e-mail. If an artwork turns out to be unavailable (for example sold at a studio visit moments earlier), we will refund your payment immediately and in full.
The contract language is English or German. We store the order data; you receive all essential terms with the confirmation e-mail.
4. Prices and payment
All prices are total prices in euro (EUR). In accordance with § 19 UStG (small-business regulation) no VAT is charged or shown. Shipping costs are listed on the Shipping & Delivery page and shown again before you order. Payment is processed by Stripe; available methods include major debit and credit cards, Apple Pay, Google Pay, PayPal and Klarna.
5. Reservation during checkout
Because each original exists only once, it is reserved for you for approximately 30 minutes once you proceed to payment. If payment is not completed in that time, the work becomes available to other buyers again.
6. Delivery
We ship insured and tracked, in professional packaging, to the countries listed on the Shipping & Delivery page. For consumers, the risk of loss passes to you when the artwork is handed over to you. Stated delivery times are estimates. For deliveries outside the European Union, import duties and taxes of the destination country are borne by the recipient.
7. Commissioned works and paintings from photo
Commissioned works — including the “painting from photo” packages — are made to your specification. After payment you send us your photo and wishes by e-mail; we align on a concept before painting begins. Since these works are personalised, the statutory right of withdrawal does not apply to them (§ 312g (2) No. 1 BGB) — see Right of Withdrawal. If we cannot realise a commission for artistic reasons, we will tell you before starting and refund the full amount.
8. Right of withdrawal
As a consumer you may withdraw from the purchase of ready-made works within 14 days without giving reasons. Details, exceptions and the model form: Right of Withdrawal.
9. Warranty
Statutory warranty rights apply.
10. Copyright
Purchase of an artwork transfers ownership of the physical object only. All reproduction rights and other rights under copyright law remain with the artist. Private, non-commercial photography of the work in your home is of course welcome.
11. Final provisions
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, this choice of law does not deprive you of the protection of mandatory provisions of the law of your country of residence.
